THE DMV
First things first. When arrested for a violation of California Vehicle Code Section 23152(b) – DUI with a BAC over .08 percent, most people will receive a pink piece of paper from the police officer. This is your temporary license. It is valid for 30 days. What most people do not do is read the whole thing. If they did, they would know that they only have 10 days from the date of arrest to contact the DMV to schedule an administrative per se hearing (ASP). If you do not, the DMV in most cases will suspend your license regardless of what happens in court. Again, this is in most cases.
