I’ve been practicing criminal defense since 2008, my whole legal career. What most people do not realize is that a DUI is a criminal matter in that it can be filed as a misdemeanor or as a felony depending on the facts surrounding the arrest.

Many people are mistaken about DUI’s. A lot of people think that just because this is their 1st DUI, they wont go to jail. The truth of the matter is, there are many factors that can potentially land someone in jail even if it’s their first. Some of the factors are, was there an accident, was someone injured, was there a hit and run involved or excessive speeding, and so forth. All these factors have the potential for the District Attorney to give an offer including jail.

If you were recently arrested for a DUI, you need to know that you only have 10 days to contact the DMV to schedule your right to a DMV administrative per se hearing. This is separate from your court matter. The DMV is there to suspend your license. The court is there to handle your criminal matter. When scheduling the hearing, it is best for your attorney to call and schedule, as there are things you need to request at the time of scheduling your hearing.
