Today is April 1, 2020. Most people are staying home during the Covid-19 outbreak. I, Jimmy Cha, have been working relentlessly during this time to ensure that my clients and prospective clients have someone to speak with during this time where many attorneys have taken the time off they deservedly need.

You would think with the rise of the Covid-19 pandemic, and the stay home order by our governor there would be no more DUI arrests. This is not the case. Yes, the amount of DUI arrests have gone down significantly. At the same time, people are still going out to friend’s or relative homes to drink, and then drive home. As a result, people are still being arrested for DUI’s in Fullerton, and all over surrounding cities.

Many lawyers not answering their phones, and many people arrested for a DUI do not know what to do. Then there’s the court closure issue where many people might have court on a day court is closed due to the Covid-19 pandemic. Don’t try to figure all this out on your own. First, if you are arrested for a DUI in Fullerton or surrounding counties like Los Angeles, Riverside, San Bernardino, and San Diego, you should know that you have 10 days to contact the Department of Motor Vehicles (DMV) to schedule an Administrative Per Se (APS) hearing. This is to ensure your drivers license does NOT get suspended unilaterally without having a hearing. I always advise my clients to have the attorney who is representing you, not any attorney but the one representing you to schedule the hearing as there are documents to request at the time of scheduling the hearing. I’ve heard many clients in the past tell me that hearing officers at the DMV will try to dissuade them from scheduling the hearing or give them wrong information. To prevent this, have your attorney, whether it is me or someone else schedule the hearing to ensure your rights will be protected.
